TERMS AND CONDITIONS
The JOB2GO LTD has its registered office in Companies House With address 1 Churchill Villas, Churchill Way, Cardiff, United Kingdom, CF10 2EA, and is registered in the trade register under number 12492859.
The services offered by JOB2GO through the Website, including offering a platform on which Self-Employed and Employers can come into contact with each other in connection with the performance of activities outside employment.
The natural or legal person who offers a Job or instructs the Self-Employed to perform work using the Website.
The natural or legal person who, through the platform, makes himself available to perform work on behalf of an Employer or registers for or offers for one or more assignments from an Employer. The Self-Employed will perform the work by means of an assignment agreement.
www.job2go.co.uk and everything related to it, including the associated Apps.
Work that Employers want to have carried out by 1 or more Self-Employed and have published on the Website.
2.1.1 JOB2GO facilitates:
- a platform where DIY jobs can be posted;
- a platform where you can acquire at Klussen;
- model contracts (including a contract for services between the Self-Employed and the Employer);
- Billing on behalf of Self-Employed; and payments.
2.2 Right of use
JOB2GO hereby grants the Self-Employed the right to use its platform.
Note that we encourage the two parties, employers and self-employed, to constantly communicate and deal with each other using the Job2Go platform, noting that any agreement between them could be happened outside the platform, and in case of any dispute between them, then Job2Go cannot assume responsibility for protecting the rights of either party.
JOB2GO is not responsible for any content posted on the platform or it’s Website. JOB2GO does of course take measures to ensure the reliability, validity and completeness of information.
2.4.1 The Self-Employed acknowledges that JOB2GO is only a means of running its own business.
2.4.2 JOB2GO never guarantees the Self-Employed independence.
2.4.3 JOB2GO makes the number of hours worked per Employer transparent for the Self-Employed.
2.4.4 The Self-Employed can work a maximum of 650 hours per year for an Employer, so that at least 3 Employers can be met on an annual basis.
3 REIMBURSEMENT, INVOICING AND PAYMENT
JOB2GO invoices on behalf of the Self-Employed. The Employer then pays JOB2GO and JOB2GO pays the Self-Employed on behalf of the Employer by means of reversed billing. The Self-Employed ensures that JOB2GO can invoice the Employer on behalf of the Self-Employed in a timely manner, in the sense that the specification of the work performed is known to JOB2GO within 2 days after the work has been completed. The JOB2GO invoice explicitly states that JOB2GO invoices on behalf of the Self-Employed.
The Self-Employed irrevocably authorizes JOB2GO to send invoices from the Project to the Employer and to receive the Employer’s payments for the Self-Employed.
However, in order to be able to receive the compensation within 7 days after the end of the Project, the Self-Employed will offer the claim under the Project against the Employer for sale and transfer to The JOB2GO BV, established at 2132 WT Hoofddorp, Siriusdreef 12 (hereinafter “The JOB2GO BV ”), In accordance with the“ Agreement to Purchase Trade Receivables ”(hereinafter“ the Purchase Agreement ”) signed by the Parties as Annex 1 to this Deed. The Purchase Agreement is concluded with the Self-Employed by The JOB2GO BV.
3.4 Power of attorney
The Self-Employed hereby irrevocably authorizes The JOB2GO BV to (a) effect a sale and transfer as referred to under 3.3 in accordance with the provisions of the Purchase Agreement and (b) payment of the purchase price payable by The JOB2GO BV for the receivables to take.
JOB2GO will immediately pay the purchase price to be received by The JOB2GO BV for the claim to the Self-Employed; the payment by The JOB2GO BV is the liberating payment for the purchase of the Self-Employed claim against the Employer.
If a claim of the Self-Employed purchased by The JOB2GO BV must be repaid to The JOB2GO BV on the basis of and in the manner as stipulated in the Purchase Agreement, The JOB2GO BV will notify the Self-Employed directly and the Self-Employed will pay the amount referred to in Article 10. of the Purchase Agreement [within 2 days] thereafter repay to The JOB2GO BV, without prejudice to the rights of The JOB2GO BV towards the Self-Employed on the basis of the purchase and transfer of the claim.
3.7 Intellectual Property
The Self-Employed remains the owner of all content and information that the Self-Employed places on JOB2GO. For content that is subject to intellectual property rights, such as photos (IP content), the Self-Employed expressly gives the following permission: The Self-Employed grants a non-exclusive, transferable, royalty-free, worldwide license to use all IP content that the Self-Employed places on JOB2GO (IE -license). This IP license ends when the Self-Employed removes IP content or account.
3.8 Sharing e-learning outcomes
The Self-Employed authorizes JOB2GO to share the results of tests completed by the Self-Employed via the JOB2GO platform with the Employer for the benefit of the Profile. This authorization can be revoked at any time by the Self-Employed.
Regarding the payment, JOB2GO only fulfills a cashier function. Payment by JOB2GO to the Self-Employed releases the Employer from its payment obligation to the Self-Employed. Furthermore, JOB2GO is in no way responsible for the actual payment by the Employer to the Self-Employed. The debtor risk always lies with the Self-Employed.
3.10 Power of attorney
The Self-Employed hereby irrevocably declares to grant JOB2GO a power of attorney to proceed to a sale and transfer as referred to in 3.3 and to agree to the conditions as set out in Appendix 1.
The employer owes job2go a user fee as the following:
2 Pound (ex VAT)per hour worked by the self employed.
Note: The minimum hour fee allowed when using Job2Go platform is 14 Pound/Hour, noting that the employer should determine the hourly rate in proportion to the job hierarchy, qualifications and job title.
Please note that we work with a third party for financial issues and bills, Its name is “Stripe”.
After the task is completed and submitted on the platform by the employer and self-employed, then the amount will be transferred within 14 days maximum.
3.12 Other fees
The Reimbursement includes travel costs, accommodation costs, any material costs, other expenses and travel time. These costs and the time associated with these costs, such as travel time, are therefore not reimbursed separately.
JOB2GO is not responsible for:
- making the declaration of income tax by Self-Employed,
- making the declaration of turnover tax by Self-Employed,
- Payments under the contract for services between the Employer and the Self-Employed.
- Fulfillment in any way of the contract for services concluded between the Employer and the Self-Employed.
Any liability of JOB2GO, in so far as it exists, is limited to € 1000 per event and € 5000 per year. Indirect and consequential damages are expressly excluded.
JOB2GO advises Self-Employed to take out business Legal Liability insurance as well as professional liability insurance and disability insurance.
The Self-Employed and JOB2GO have the right to terminate the registration at any time, without reason and without the other being liable for damage resulting from a termination.
And in the event of any misuse of the Job2Go platform or committing any fraudulent violation, we, as the owner of Job2Go, have the right to freeze the user’s subscription and cancel his account.
7 CONTRACT AGREEMENT
As a service with its platform, JOB2GO makes a template contract assignment available to the Self-Employed and the Employers. Parties are free to make other arrangements themselves, but will not deviate from the articles in these conditions. However, JOB2GO cannot guarantee whether or not an employment relationship exists between the Employer and the Self-Employed. The Employer and the Self-Employed must make clear agreements in this regard, which are in line with current legislation. The actual situation between the Employer and the Self-Employed must also correspond to what is included in the template agreement.
7.2 JOB2GO not a party
The assignment agreement is entered into by the Self-Employed and the Employer. So JOB2GO is not a party to this agreement. JOB2GO is not liable for the quality of the work that Self-Employed provide or the quality of the assignment placed by Employers. JOB2GO is not liable or responsible for the acts or omissions of an Employer or Self-Employed in any form. JOB2GO is not responsible for the information provided by the Employer in the order form or if the Employer does not comply with applicable laws and regulations, intellectual property rights and privacy legislation for third parties.
7.3 650 hours
If the Employer, before a Self-Employed has performed 650 hours of work for the Employer, enters into an employment contract or an agreement with the Self-Employed directly without JOB2GO’s intervention, the Employer will owe JOB2GO a fee that is calculated as follows: (650 minus the number of hours worked by the Self-Employed for the Employer via the platform) multiplied by EUR 1, – ex VAT.
The Self-Employed will notify JOB2GO immediately, but in any case within 14 days, as soon as an (employment) agreement is concluded between the Employer and the Self-Employed without the intervention of JOB2GO, failing which the Employer will owe an immediately due and payable fine of EUR 3,000. -.
JOB2GO is entitled to (temporarily) take the Website out of use or to restrict it if, for example, this is necessary for the maintenance or adjustment of the Website, without this giving rise to any right to compensation towards JOB2GO.
9 RATINGS / REFERENCES
9.1 A Employer is entitled to add a rating / reference to the profile of the Self-Employed through whom it has carried out certain activities. In the rating / reference, the data requested there are provided by the Employer.
9.2 The Self-Employed guarantees that the information provided in the reference is in good faith, transparent and truthful and indemnifies JOB2GO against any claim by a third party in this respect.
9.3 JOB2GO is entitled to remove a reference at any time. It can do this, but not exclusively, if, as a result of a notification, it appears that the reference is incorrect, unreliable or unmistakably unlawful, or otherwise does not meet the conditions.
9.4 A reference must in any case meet the following conditions:
– a reference should not contain defamatory, vulgar, obscene or racist language;
– a reference may not contain any personal information regarding a Self-Employed;
– a reference may not contain links and / or scripts;
– a reference must have been added by the Self-Employed and must relate to the Self-Employed by whom the assignment has been carried out.
10.1 Maximum hours
The Self-Employed will carry out work for the same Employer for a maximum of 650 hours per year on the basis of one or more agreements as referred to in Article 7.
Without the prior approval of JOB2GO, the Self-Employed could not enter into any agreements with an Employer other than one or more engagement agreements as referred to in Article 6.
The Self-Employed is free to be replaced during the work by another person, who may or may not appoint the Self-Employed via the Mediator platform. The Self-Employed guarantees that the other person is authorized to work in the Netherlands and can also demonstrate this if requested. In addition, the Employer does not have the right to refuse the replacement (s). In the case of replacement, the Self-Employed has a valid reason for which he / she cannot work the service and reports to the Employer before the replacement process who will perform the work on his / her behalf. It is not allowed to arrange replacement in advance and to act as an intermediary yourself through our platform.
If the Self-Employed cancels the contract for services outer the agreed cancellation period, Article 10.3 will take effect. if no replacement would be provided by the Self-Employed, a choice will be made by the Employer for the relevant Project. The Employer indicates per Klus whether or not it is satisfied with the handling of the cancellation or no-show by the Self-Employed. If satisfied, there is no consequence for the Self-Employed. If not satisfied, a follow-up process will start.
- For assignments in the future to which the Self-Employed is matched, each Employer of the assignment concerned will be informed of the cancellation. Employers are given the choice, if desired, to cancel the match. If this happens outside the applicable cancellation period, the possibility of claiming the Project for the Self-Employed lapses.
- In the case of DIY in the future to which the Self-Employed has responded, but where no match has yet been made, the response will be undone.
- The Self-Employed is given the choice by email to remain active on the platform. This can be done by paying a deposit worth € 100. The Self-Employed must respond within 72 hours (3 days) and indicate his or her choice.
- If the Self-Employed desires to pay the deposit, the Self-Employed will receive an I-Deal link by email to transfer the amount. This must be done within 24 hours (1 day).
- If the Self-Employed does not respond within 72 hours (3 days) after the alert and / or does not transfer the deposit within 24 hours (1 day), the Self-Employed will still be automatically deregistered from Kluss and for which the Self-Employed was already matched. The Self-Employed also has no chance to respond to new Kluss .
- The Self-Employed can claim the deposit again as soon as he / she has successively executed 10 Kluss , without having to deal again with an cancellation outside the term or a no-show. The Self-Employed must actively contact JOB2GO (support@JOB2GO.works) to have the deposit paid out.
11.1 In order to use the JOB2GO Services, an account must be created in the manner described on the Website, stating the information requested.
11.2 An account is only created when JOB2GO has accepted the request to place an account in writing. JOB2GO is entitled to refuse or remove (creating) an account and / or a bid or other information by the Self-Employed without stating reasons.
11.3 A password will be provided to the Self-Employed for the account. The password is strictly personal and the Self-Employed may not let third parties use it. The Self-Employed is liable for any use made of his account and indemnifies YoungCapital against any claims by third parties regarding damage or otherwise, in any way arising from the use made through his account of the Service.
11.4 JOB2GO is entitled to change the password if this is necessary in the interest of the functioning of the service.
JOB2GO reserves the right to exclude the Self-Employed from any (further) use of the Website, including by blocking and / or deleting his account, without being obliged to refund any fees already collected, if:
– the Self-Employed infringes (intellectual property) rights of third parties;
– the Self-Employed runs an employment agency or a comparable company;
– the Self-Employed places a reference to a Project that has been placed on the Website by the Self-Employed itself;
– the Self-Employed acts in violation of applicable laws and regulations.
– the Self-Employed is treating employees of JOB2GO or Employers inappropriately by means of defamatory, defamatory, vulgar, obscene or racist language.
13 FORCE MAJEURE
JOB2GO is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. Force majeure also includes a non-attributable shortcoming of suppliers and / or other third parties that JOB2GO uses.
JOB2GO makes every reasonable effort to protect its systems against loss and / or any form of unlawful use. JOB2GO implements appropriate technical and organizational measures for this, taking into account, among other things, the state of the art.
